Charges against board members
During a recent investigation of the Hammock’s Community Association, charges were filed against five executives including the president of the HOA and the wife of the president, along with two other board members. The investigation centered on board members writing checks to vendors for services that were not provided, and then diverting a portion of the money for their own personal use.
A lawsuit was filed against the Gallego family after they allegedly received more than $2 million through five shell companies that were run by Gallego and her husband. The money was taken from HOA funds and then used for personal expenses, including the purchase of a pink playhouse for a child. Other vendors returned the money and the Gallego family kept part of it.
Gallego was arrested last year and faces further charges. She was the president of the HCA when she was arrested. The attorney for the case did not respond to an AP email seeking comment.
Jose Antonio Gonzalez, Marglli Gallego’s husband, is also accused of using HOA funds to operate two companies. He was arrested in April and faces charges. This is part of a long-running investigation into the HCA. The State Attorney said some homeowners had to pay over 400 percent more in maintenance fees. The investigation also included allegations of money laundering.
The HOA board had a budget of more than $10 million. That’s more than twice the average HOA budget in Florida. A recent lawsuit against the HOA board said the budget was too large and should be changed. The new budget will mean monthly maintenance fees increase up to 400 percent. The lawsuit says the board adopted the new budget to help fund the costs of the lawsuit.
The Hammocks Community Association oversees 40 communities in West Kendall. It is one of the largest homeowners associations in the state. It is also a large neighborhood with over 18,000 residents. Several of its board members have been arrested in the past. The State Attorney said the investigation is still ongoing and more arrests are possible. The lawsuit is now in court.
